Acceptable Use Policy

1. Purpose

38Hub is designed to empower content creators with AI-powered tools for ideation, writing, visual design, and publishing workflows. This Acceptable Use Policy exists to ensure the safe, lawful, and responsible use of the Service and to protect the rights and well-being of all users, third parties, and the public. This policy applies to all content created, stored, processed, or distributed through the Service, whether created manually or with the assistance of AI tools.

We reserve the right to determine, at our sole discretion, whether any use of the Service violates this AUP, whether or not that specific use is explicitly listed as prohibited below. The prohibited uses listed in this policy are illustrative, not exhaustive.

2. Prohibited Uses

You may not use the Service for any of the following purposes. This list is illustrative and not exhaustive. We reserve the right to determine, at our sole discretion, that any use not listed below violates the spirit of this policy:

2.1 Illegal Activity

You may not use the Service to create, store, transmit, or distribute content that violates any applicable local, national, or international law or regulation. This includes content that promotes or facilitates illegal activities, violates export control or sanctions laws, or relates to the sale or distribution of controlled substances, weapons, or other prohibited items.

2.2 Harassment, Hate Speech & Violence

You may not use the Service to create content that harasses, bullies, intimidates, threatens, or stalks any individual or group. This includes content that promotes discrimination, hatred, or violence based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic. Content that incites, glorifies, or trivialises violence against any person or group is strictly prohibited.

2.3 Sexually Exploitative Content

You may not use the Service to create, store, or distribute child sexual abuse material (CSAM), non-consensual intimate imagery, or any other sexually exploitative content. Any such content will be reported to the appropriate law enforcement authorities.

2.4 Spam & Manipulation

You may not use the Service to generate bulk unsolicited messages, comments, or other communications. This includes mass-producing low-quality content for search engine manipulation, link farming, artificial engagement inflation, or astroturfing. Automated posting of content to external platforms in violation of those platforms' terms of service is also prohibited.

2.5 Malware & Security Threats

You may not use the Service to create, store, or distribute malicious software, scripts, or code. You may not attempt to probe, scan, or test the vulnerability of the Service or any connected system. You may not conduct denial-of-service attacks or any activities that disrupt the availability of the Service for other users.

2.6 Deceptive Content & Fraud

You may not use the Service to create content that is intentionally misleading or deceptive, including phishing content, scam pages, fake reviews, fraudulent testimonials, impersonation of brands or individuals, or content designed to defraud or manipulate others.

2.7 Intellectual Property Infringement

You may not use the Service to reproduce, distribute, or create derivative works from copyrighted material without proper authorisation. You may not use the Service to infringe on trademarks, trade secrets, patents, or other intellectual property rights of third parties.

2.8 Privacy Violations

You may not use the Service to collect, store, or process personal data of third parties without their consent or a valid legal basis. You may not use the Service to dox, stalk, or otherwise violate the privacy rights of any individual.

2.9 Competitive Misuse

You may not use the Service to build a competing product or service, benchmark the Service for competitive purposes without our written consent, or systematically extract data, features, or methodologies from the Service for use in another product.

2.10 Account Abuse

You may not create multiple accounts to circumvent restrictions, share account credentials with third parties, sell or transfer your account, or use the Service on behalf of a sanctioned entity or individual.

3. AI-Specific Rules

The use of AI-powered features within 38Hub carries additional responsibilities. The following rules apply specifically to your use of AI content generation, scoring, and analysis features:

3.1 No Generating Harmful Content

You may not use AI features to generate content that promotes, incites, or provides instructions for violence, self-harm, terrorism, or any illegal activity. This includes using prompt engineering techniques or other methods to bypass AI safety filters. If an AI feature produces harmful content unexpectedly, you must not publish or distribute that content.

3.2 No Impersonation

You may not use AI features to impersonate real individuals without their consent. This includes generating content in the voice, style, or persona of a specific real person in a way that could mislead others. Parody and satire are permitted only if clearly labelled and cannot reasonably be mistaken for genuine content.

3.3 No Deepfakes

You may not use AI image or video generation features to create realistic synthetic media depicting real individuals without their explicit consent. AI-generated visual content depicting fictional scenarios involving real people in compromising, sexual, or degrading situations is strictly prohibited.

3.4 No Disinformation

You may not use AI features to generate or amplify disinformation. This includes AI-generated fake news, fabricated claims, false political content, conspiracy theories presented as fact, and health misinformation. You are responsible for fact-checking all AI-generated content before publishing.

3.5 No Automated Weapons or Surveillance

You may not use AI features to develop weapons systems, surveillance tools, systems designed to manipulate individuals or groups, or any other applications that could cause serious harm to individuals or society.

4. Content Guidelines

4.1 User Responsibility

You are solely responsible for all content you create, upload, store, generate, or distribute through the Service, whether created manually or with AI assistance. You bear full legal responsibility for your content, including compliance with all applicable laws, regulations, and third-party rights. 38Hub assumes no responsibility or liability for User Content.

4.2 Original or Properly Licensed Content

All content you create, upload, or store on the Service should be original or properly licensed. If you use third-party content as inputs for AI features, you must have the appropriate rights. You are responsible for ensuring that AI-generated output does not infringe on the intellectual property rights of others.

4.3 Factual Accuracy

You bear sole responsibility for the factual accuracy of content you publish using the Service. AI models can produce plausible-sounding but incorrect information. You must independently verify all factual claims, statistics, quotes, and references before publishing. 38Hub provides AI as a creative tool, not as a source of truth, and disclaims all responsibility for inaccuracies in content you publish.

5. Technical Restrictions

5.1 No Reverse Engineering

You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, data structures, or underlying ideas of the Service or any part thereof. You may not attempt to reconstruct or discover any source code, underlying algorithms, file formats, or API protocols of the Service through any means.

5.2 No Scraping or Automated Access

You may not scrape, crawl, spider, or use any automated means to access the Service or extract data from it. You may not use bots, scripts, browser extensions, or other automated tools to interact with the Service in any way that is not expressly authorised by us in writing. You may not collect or harvest any information from the Service, including user data, content, or system information.

5.3 No Circumvention

You may not attempt to circumvent, disable, or interfere with any security, authentication, rate limiting, access control, or other protective features of the Service. You may not access or use the Service through any means not provided or authorised by us.

5.4 No Unauthorised Integration

You may not integrate, connect, or interface the Service with any third-party application, service, or system without our prior written approval. You may not use the Service as a proxy, gateway, or intermediary to access third-party services.

6. Rate Limits & Fair Use

To ensure consistent performance and availability for all users, the Service implements rate limits and fair use policies on various features, including AI operations, API calls, file uploads, and content generation:

• AI Operations — Each subscription plan includes a fair-use allocation of AI operations. Exceeding your plan's allocation may result in temporary throttling or suspension of AI features until the next billing cycle.
• API Rate Limits — Requests to our API are rate-limited per user and per IP address. Exceeding these limits will result in temporary throttling (HTTP 429 responses).
• Storage Limits — Each plan includes a storage allocation for file uploads. Exceeding your storage limit may prevent additional uploads until you free up space or upgrade your plan.
• Fair Use — All "unlimited" features are subject to a fair use policy. Usage that is significantly above the average for your plan tier, or that places an unreasonable burden on our infrastructure, may be throttled or restricted at our sole discretion.

We reserve the right to modify rate limits and fair use thresholds at any time. Current limits for each plan are published on our pricing page.

7. Enforcement

We reserve the right to investigate and take appropriate action against any violation of this AUP at our sole discretion. We may, but are not obligated to, monitor your use of the Service for compliance with this AUP. Our enforcement actions may include, without limitation:
